
Blocking accounts without a court: the EU makes banks the extended arm of the tax authorities
Whether receiving money, transferring money or withdrawing cash - every citizen is under general suspicion.
With silent changes to general terms and conditions, reversal of evidence and the new EU authority AMLA, banks are increasingly taking on the role of government agents.
🏦 Banks are no longer service providers - they act on instructions from the authorities
Almost all banks in the EU have now amended their general terms and conditions. They state, in essence:
"The bank is obliged to block your account on the order of an authority - without a court order, without proceedings, without a legal hearing."
A digital instruction from a financial authority is sufficient - your access to the account is blocked. You are not asked. You have no recourse. Your money is gone.
Revolut was just the last domino to fall. Savings banks, Volksbanks, Commerzbank, Deutsche Bank, ING, DKB - they have all had such clauses in place for a long time.
⚖️ Reversal of the burden of proof: you have to prove your innocence
The rules of the game have changed:
- You used to have to prove illegal behavior.
- Today, you have to prove that everything is above board.
An unusual incoming payment? A transfer from abroad? A large withdrawal?
That alone can be enough to block your account. And then you have to prove where the money came from and that it is legitimate.
💶 Portugal as a pioneer: cash use only with restrictions
Portugal currently has the strictest cash regulations in the EU:
- Cash payments of 3,000€ or more are prohibited for residents
- For taxpayers even prohibited from 1,000€
- Only foreigners are still allowed to pay up to 10,000€ in cash
Even for everyday amounts, you have to pay electronically - or risk a fine.
🧠 AMLA - the new EU authority with access to everything
The new EU authority AMLA (Anti-Money Laundering Authority) has been active in Frankfurt since July 2025.
- Banking supervision throughout Europe
- Monitoring of all financial transactions
- Direct authority to issue instructions to banks
AMLA, tax authorities and banks will act as a joint control system in future.
The aim: real-time monitoring of all account movements - centrally, EU-wide, without judicial control.
